Terms of Service

These Terms of Service ("Terms") govern your access to and use of Samba360 (the "Service"), operated in Kenya. By creating an account or using the Service you agree to these Terms. If you are using the Service for a business, you confirm you are authorised to bind that business.

2. Plans and activation

There is no free trial. New businesses choose a plan (from KSh 1,200 per month) and activate it by paying by M-Pesa. A workspace becomes active once the first payment is confirmed, and stays active while renewals are paid.

You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its operation, reverse engineering it, or using it to break any law (including tax, fiscal and data-protection law).

5. Your data and content

You own the business data you enter. You grant us the rights needed to host, process and back up that data to provide the Service. You are responsible for the lawfulness of the data you enter, including customer data.

6. Availability and support

We aim to keep the Service available and to fix faults promptly, but we do not guarantee uninterrupted or error-free operation. Support is provided through the contact details below during normal working hours.

7. Intellectual property

The Service, its software and its branding are owned by us or our licensors. These Terms do not transfer any ownership to you; you receive a limited, non-exclusive right to use the Service.

8. Limitation of liability

To the maximum extent permitted by Kenyan law, we are not liable for indirect or consequential losses, lost profits, or loss of data caused by events beyond our reasonable control. Our total liability is limited to the fees you paid for the Service in the three months before the claim.

9. Suspension and termination

We may suspend or terminate an account for non-payment or breach of these Terms. You may stop using the Service at any time; see our Refunds & Cancellation policy. On termination we may retain data as required by law, after which it may be deleted.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in the Service or by email. Continued use after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
